Florida H.B. 1213

Creates the Prostate Cancer Task Force to identify gaps in public education and research and to improve public awareness about prostate cancer; requires development of standardized prostate-related written summaries.
H.B. 3783 Dedicates a specified percentage of the Alcoholic Beverage and Tobacco Trust Fund to the development of a cancer research facility at the University of South Florida.
S.B. 720 Eliminates an exemption relating to minors working in conjunction with law enforcement agencies to test tobacco dealer compliance.
S.B. 1268 Creates the Tobacco Settlement Trust Fund to accept deposit of all funds received by the state as a result of its tobacco industry settlement.

H.B. 618 Prohibits specified insurers from excluding coverage for any off-label use of a drug prescribed for the treatment of cancer.
H.B. 864 Requires specified insurers that cover mastectomies to also make available and offer coverage for post-mastectomy breast reconstruction surgery.
S.B. 146 Authorizes peace officers and employees of the state Department of Agriculture to issue citations to juveniles who obtain tobacco products by way of retail sale, vending machine, or product samples; specifies penalties against minors.
S.B. 247 Creates the Tobacco Settlement Agreement Fund; specifies priorities for distribution of funds from the Federal tobacco settlement.

Nebraska L.B. 1070 Establishes the Nebraska Health Care Fund Act to specify uses for tobacco settlement funds; establishes the Native American Public Health Act to provide tobacco education and breast and cervical cancer early detection services.
New Hampshire H.B. 147 Requires the state Department of Health and Human Services to make publicly available tobacco product ingredient information on an annual basis.
S.B. 497 Mandates that state tobacco-related funds are subject to the same requirements as Federal block grants.
New Jersey A.B. 553 Prohibits smoking in indoor areas of child care centers when children are present; includes a sign- posting provision; specifies penalties.
Oklahoma H.B. 3169 Prohibits employers and certain insurers from discriminatory practices against employees or policy-holders on the basis of genetic testing or genetic information; specifies penalties.

South Carolina

H.B. 3985 Requires specified insurers to provide coverage for breast, cervical, and prostate cancer-related services.
S.B. 535 Prohibits: (1) specified insurers from discriminatory practices based on genetic information, and (2) the performance of genetic tests without prior consent: specifies penalties.
Vermont H.B. 749 Establishes a cause of action allowing the state to recover Medicaid benefits for tobacco-related health conditions from tobacco manufacturers.
Virginia

H.B. 542 Requires specified insurers to provide coverage for post-mastectomy inpatient care.
H.B. 610 Requires state employee health care plans and the state plan for medical assistance services to provide coverage for annual Pap smears.
H.B. 915/S.B. 705 Require certain insurers to provide coverage for one PSA test in a 12-month period and digital rectal examinations.

Requires the state Board of Medical Assistance Services to include in its plan a provision for payment of medical assistance for prostheses following medically necessary breast removal procedures.
H.B. 1202 Requires the state Board of Medical Assistance Services to include medical assistance payment provisions for low-dose screening mammograms; specifies mammography quality guidelines.
H.B. 1430/S.B. 716 Authorize the state Alcoholic Beverage Control Board to use state tax information to create and maintain a list of retail tobacco dealers to facilitate enforcement of tobacco product sales to youth laws.
