Occupational Exposure Reduction

New York passed a law (A.B. 2958) designed to determine the eligibility of firefighters for an accidental disability retirement allowance. Until June 3, 1998, the law presumes that disability or death from melanoma or certain types of cancer was incurred in the line of duty unless proven otherwise by competent evidence. Presumption is dependent upon a firefighter having passed, upon entry into firefighter service, a physical examination that failed to reveal any evidence of melanoma or any other cancerous condition affecting the lymphatic, digestive, hematological, urinary, or prostate systems.
