State-of-the-Art Treatment Legislation passed in Minnesota (S.F. 1076/H.F. 1306) prohibits specified individual and group insurers, including health maintenance organizations and Medicare supplement policies, that provide coverage for drugs from excluding coverage of a drug for cancer treatment because the drug has not been approved by the Federal Food and Drug Administration (FDA) for the treatment of cancer. Drugs must be covered if they have been recognized for the treatment of cancer by specified reference compendia or medical literature. Coverage must include medically necessary services required for the administration of the drug, and coverage must not be subject to any copayment or deductible greater than that applied to other drugs. Coverage is not required for: (1) drugs determined by the FDA to be contraindicated, (2) experimental drugs not otherwise approved for any indication by the FDA, and (3) non-formulary drugs. |
